Terms and Conditions

Effective November 30, 2010

Your application to participate in the Circle K Furniture Loyalty Program and each use of your Inner Circle Loyalty Card constitutes an agreement to these terms and conditions, which Circle K Furniture reserves the right to change at any time without notice.  These terms and conditions contain warranty disclaimers and limitations of liability, as conspicuously noted below.

Circle K Furniture may change these terms and conditions and the benefits and privileges under the Loyalty Program and the Inner Circle Loyalty Cards, including the conditions of eligibility, at any time in its sole discretion and without notice to you.  During your participation in the Loyalty Program, it is your responsibility to periodically visit Circle K Furniture's website to view any changes.  It is your responsibility to present your Loyalty Program number or Inner Circle Loyalty Card at the time of any purchase in order to receive the benefits and privileges related to the Loyalty Program.

Participation in the Loyalty Program and the Inner Circle Loyalty Card carries no fees.  Participants must be 18 years of age and valid legal residents of the United States or Puerto Rico to be eligible for Loyalty Program and Inner Circle Loyalty Card benefits.

Participation in the Loyalty Program, including use of the Inner Circle Loyalty Card, is a rewards participation program and does not carry a cash balance.  Inner Circle Loyalty Cards are not credit cards or debit cards, and you may not reload them.  You may not use Loyalty Program or Inner Circle Loyalty Card benefits and privileges to pay a bill or to purchase Gift Cards.  Loyalty Program and Inner Circle Loyalty Card benefits and privileges are not redeemable for cash or merchandise.  You may not transfer your Loyalty Program or Inner Circle Loyalty Card benefits and privileges to any other person, including your estate, successor or assign, nor combine your benefits and privileges with the benefits and privileges of any other person.

The Loyalty Program and Inner Circle Loyalty Cards are the sole property of Circle K Furniture, which reserves the right to rescind your benefits and privileges at any time, for any reason, without notice, except where prohibited by law.  Without limiting the foregoing, Circle K Furniture may rescind, cancel or disqualify you from participation in the Loyalty Program and use of the Inner Circle Loyalty Card if it determines, in its sole discretion, that there has been an abuse of the program, including the failure to follow these terms and conditions, the sale or barter of a reward or benefit, or any misrepresentation at the time of enrollment or in connection with your account profile.  Circle K Furniture may terminate the Loyalty Program in its entirety, and eliminate all Inner Circle Loyalty Cards under the Loyalty Program.  Participants in the Loyalty Program and holders of Inner Circle Loyalty Cards have no vested interest or property rights in the benefits and privileges of the Loyalty Program or Inner Circle Loyalty Cards.  If there is no account activity, which includes use of your Loyalty Program number or Inner Circle Loyalty Card, for a period of twenty-four months, your Loyalty Program account may be terminated and all accrued benefits, if any, will be forfeited.  You may re-apply for a new Inner Circle Loyalty Card, subject to eligibility requirements.  The Loyalty Program is administered, and Inner Circle Loyalty Cards are issued, under the laws of the State of Florida.

Circle K Furniture will replace a lost, stolen or damaged Inner Circle Loyalty Card with appropriate identification.  To check the status of your benefits under the Loyalty Program or your Inner Circle Loyalty Card, e-mail us at information@circlekfurniture.com or call 904.781.1079.

PRIVACY

By providing your e-mail and mailing addresses in your application for the Loyalty Program, you grant Circle K Furniture permission to contact you with information, notifications and offers.  We will hold your personal information in accordance with the Circle K Furniture privacy policy, which you can find on our website at www.circlekfurniture.com/privacy. You may opt out of any of these communications by e-mailing us at information@circlekfurniture.com or calling 904.781.1079, or by unsubscribing via an e-mail link on any communications you receive.  If you opt out of communications, certain benefits and privileges with the Loyalty Program and Inner Circle Loyalty Cards will become unavailable to you.  To update your contact information, e-mail us at information@circlekfurniture.com or call 904.781.1079.  Circle K Furniture is not responsible for any lost benefits or privileges as a result of your failure to provide accurate or to update your contact information or as a result of your election to opt out of communications.

WARRANTY DISCLAIMER

Circle K Furniture makes no warranties, express or implied, including any warranty of merchantability or any warranty of fitness for a particular purpose, in connection with the Loyalty Program, Inner Circle Loyalty Cards, or any benefits or privileges associated with the Loyalty Program or Inner Circle Loyalty Cards.  Without limiting the foregoing, Circle K Furniture makes no warranty regarding the continuance or availability of benefits and privileges under the Loyalty Program or Inner Circle Loyalty Cards.

limitation of liability

You agree as a condition of participation in the Loyalty Program and issuance of an Inner Circle Loyalty Card that, to the extent permitted under applicable law, Circle K Furniture is not responsible or liable to you or anyone else for any loss or injury or any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages under any contract, negligence, strict liability or other theory arising out of, based upon, connected with, incidental to or related to:

1. the inability to use the Loyalty Program or Inner Circle Loyalty Cards;
2. any benefits or privileges used or obtained through the Loyalty Program or Inner Circle Loyalty Cards;
3. loss of access to, deletion of, failure to back up or failure to store any information associated with the Loyalty Program or Inner Circle Loyalty Cards;
4. alteration, rescission or termination of any benefits or privileges associated with the Loyalty Program or Inner Circle Loyalty Cards; or
5. any other matter relating to the Loyalty Program or Inner Circle Loyalty Cards.
